Terms and Conditions
The Contract between parties namely the Customer and Rooflines Merchants Ltd begins on acceptance and acknowledgement of receipt of monies applied for and this applies only to each part within the whole part of the agreement. The acknowledgement states production stage whether in preparation or in actual Manufacture. A separate Job Reference for each is provided and it is this that applies to that specific item of work or service and does not form part of the overall agreement.

- Any amendments to the specified work/s or additions must be advised/requested not less than 7 days prior to the scheduled manufacture/ fitting/supply date.
- Damage to or adjustment to the product/s without our consent voids the warranty.
- Any work done by third parties which can relate to or connect to our work once completed or delivered voids the warranty.
- Supply only, although the Fitting Guide is just that, we supply on the understanding that you the customer is capable of fitting our product or you are employing a competent person on your behalf.
- Supply only, statutory law provides that we, from delivery/ collection- a 12 month product warranty.
- For ancillary products sold alongside or separate to the main product, being the curved PVC gutter, these conditions apply.
- Works undertaken for the Customer by third parties are the responsibility of the third party.
- Pattern Paper issued for Template making, the fee is non- refundable unless stated in the quotation. The pattern template received from the Customer forms part of the contract.
- From the Template pattern received made by the Customer, for the Curved Gutter we make a ‘hard ‘ timber copy in ‘convex’ form, from this the shape or form goes to production for the gutter. and any special angles/welds, the products finished is/are based on the paper pattern the Customer has provided.
- Templates made by the Customer or replicated from Paper Templates provided by the Customer are held from date of receipt of the finished Gutters for 14 days only and can then be disposed.
- The curve of a bow can differ in parts, if the template is not consistent then a further shape or form needs to be made, this can affect the price and timing.
- We make a curved gutter and the process does not allow for any STRAIGHT sections within its curve although we purposely provide longer than described with straight ends for connections, if a template or requirement to have or has a straight part in its curve , if possible we will endeavour to make within the curve itself, if not then we shall interpolate the curve to the outer lines of the curve provided or required.
- Prices are quoted in per linear metre made pieces, should we be required to make in each or a separate section then a price adjustment will/can be made the prices are per piece made not a linear price.
- From delivery/ issue/collection of the finished Gutter and or any special welds, the Customer has 14 days to provide any claim for fault, beyond this 14 days any and all templates both paper pattern and hard copies can be destroyed.
- Deliveries are to mainland UK – offshore islands and export to overseas deliveries are shipped to the nearest port of departure, or collection from a depot of ours or assigned and the Customer and or the onward carrier is then responsible for the goods.
- Although we may provide a delivery date/schedule from template receipt, the actual delivery may vary according to location of delivery including other deliveries in the same geographical region or ‘on route’ and any other factors we may not envisage at the time of quotation. If rescheduled deliveries are required beyond the advised planned then we are at liberty to charge or such delivery and with prior advice.
- Quotations given are current at the time, the price can be changed at the time of order. The price can change if from Template make or request, the funds requested are delayed or received more than 14 days after.
- We reserve the right to change the specifications shown or provided, if after a contract or agreement has been made, we shall endeavour but not required to advise.
- Marketing- we reserve the right to use photographs of the property and the installation concerned and any comments made.
- Payments made by other third parties for the requested payment/s do not alleviate the responsibility or liability for the contract between you and ourselves.
- The Gutter is made by a process, this is not a precision extrusion as standard gutter, variations in form and profile can occur and this you accept. Some popular RAL shades – 8003 /8001 in light brown, we may make the Gutter with a light brown trough, Anthracite 7016 would normally be black in the trough, but could be grey.
- The dimensions and length are given as nominal which means they can differ slightly in length and form, most, when made have a small length at each end which is as intended in the make to be ‘straight’- this can allow for connections to existing gutter/s or fittings.
- For practical purposes we generally find that curved gutter is often laid ‘level’. Gutters to existing structures are only able to be fitted to line with the existing levels and not to falls. Gutters all have sufficient capacity for the relevant area to the outlet level or a ‘fall’ as required, whether present or to be installed.
- Spigots whether fitted or supply only are designed in its shape to suit the trough, the spigot has a ‘rim’ this prevents the spigot from ‘going’ through the hole cut, this ‘rim’ sitting slightly above the trough line is not a detrimental aspect to the functionality of the gutter.
- During higher design rates of rainfall eaves gutters are designed to ‘overtop’ as there is no perceived risk or strucural integrity to the building or its contents.
- The fitting guide explains and this also advises that ’cutting’ the gutter to suit a curve must always be taken from each end, thus taking the straight parts first.
- Payments taken for the pre-make of the Curved gutter and any Straight section, Special corners that we make and or fittings whether in a standard shade, Black/White/Grey or in a special RAL colour we provide are fixed at the time of request of payment, unless delayed payments are received, we then have the right to charge any additional costs.
- Should payments from the request issue date be delayed we have the right to adjust the price prior manufacture.
- Once in receipt of the requested payment/s we place into the production run and any request for refund/s thereafter cannot be accepted.
- The make process commences the week beginning save for statutory holidays, requested payments for such week are to be received by 4pm the prior Friday, otherwise the production is placed into the following week, and subject to having sufficient time to make the gutter products within the given advised time.
- Delivery dates are subject to requested payments being made and delays can incur a price adjustment.
- Deliveries are scheduled throughout the UK Mainland, should when advised of the delivery, we are unable to either access or that there is no one of responsibility to receive the goods then we shall have the right to keep the goods in the delivery vehicle and return when a receipt as indicated is available. A re-delivery charge can be requested prior the second or any subsequent delivery until delivery is under this clause can be achieved.
- Delivery times advised are based on a 5 day week and do not include Statutory and Bank Holidays and as pre-advised, works closures.
- The Consumer Rights Act 14 day rule for distance selling does not apply as work will have commenced and furthermore whether it does or not come under the act, this is a bespoke and specialist product and likely production will have commenced prior any of either the 7 day or 14 days. Business users have no rights under the Act.
- If we have made an error in manufacture that is not attributed to your template, deliveries have been made and are not as the template you or we have made, then we shall endeavour in the first instance to re make and re deliver without charge.
- We reserve the right to make our best judgement on supplying the number of pieces, the quantity and lengths advised can change.
- Welded special corner/pipes angles are subject to the template or angle degrees taken or provided, welding can slightly distort but is not detrimental to its performance, we will not provide a weld not able to fit, or we remake. If the angle provide by others does not fit, a remake at the same charge will be applied and a delivery charge will then apply.
- Fitting Service: this is a complete service from, we, making a site visit/s, making the Template/s – the making of the necessary items to form and make the /curved gutter and or any ancillary pieces of gutter and fittings.

38a – We require at all times that you the Customer to provide a safe working platform on which to carry out our work and to remain in place during and after the works are complete at which point when you the Customer is satisfied within the 7 day period, the working platform, your full responsibility is at your choice to have removed. Removing the platform prior to 7 days provides further satisfaction to our work. Electric or other conduit requiring sheathing is the responsibility of the Customer.
If we find on our initial and any subsequent visit/s that such working platform is not suitable we have to right to withdraw any planned work until such time is it safe. Each visit, aborted due to this is an item charged at £500.00nett.
- 38b – If we have elected that the works do not require a working platform and that the area of work to which we are to carry out the ‘full service’ we may elect to provide our own work platform and this will be advised and part of the agreement.
- 38c – There are instances with our service where we may suggest the services of a third party to fit our product/s or undertake other works on your behalf whilst having the benefits of our product/s – as we would not be or need to be involved as we would have supplied only our product/s, these products being the main purpose of the contract, we do not accept any liability for the third party their schedules or their work or actions in such undertaking.

- Licensed or sub-contract persons or organizations that carry out the works described, whether labour only or supply and or fix only, are the responsible parties whilst effecting the works, and for the statutory periods thereafter.
- Our rights to end the contract
- 40.1 We may end the contract if you break it. We may end the contract for a product at any time by writing to you or electronic communication if:(a) you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due;
(b) you do not, within 14 days of us asking for it, provide us with information that is necessary for us to provide the products;
(c) you do not, within a reasonable time, allow us to deliver the products to you;
- 40.2 You must compensate us if you break the contract. If we end the contract in the situations set out in clause 40.1 we will refund any money you have paid in advance for products we have not provided or produced but as production of products ongoing or finished we will charge you accordingly and we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
- 40.1 We may end the contract if you break it. We may end the contract for a product at any time by writing to you or electronic communication if:(a) you do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due;
- These terms and conditions are relevant at the time of acceptance, these can change at the time of contract.
